Washington State has passed a new “uniform” power of attorney act that took effect January 1st.
The new law does not invalidate old powers of attorney, but has allowed us to streamline our documents.
Under the new law, there are timelines for banks, brokers and 3rd parties to accept a power of attorney.
The new law also clearly spells out the duties of an agent acting under a power of attorney and provides more details on the agent’s authority.
A new year is often a good time to review your existing estate planning documents and ensure that they still meet your needs. A word of warning of particular interest to elders and their family or friends. There is an active scam in Washington regarding jury duty and fraudulent claims that a warrant has been issued: "Individuals who claim to be county law enforcement officers or court staff accuse the residents of failure to respond to a jury summons. They often demand immediate payment of a fine to avoid issuance of an arrest warrant." Don't fall for it!! Write down all the information they provide and Call 911 immediately.
