Respuesta: Es cierto que los agentes de ICE detuvieron a un joven con estatus válido de DACA en Des Moines, WA. [02/15/17]   Question: Is it true that ICE is now going after people with DACA?

Answer: It is true that ICE agents detained a young man with valid DACA status in Des Moines, WA. According to the government report, ICE agents had a warrant for his father’s arrest, but they also took the young man, Daniel Ramirez Medina, into custody “based on his admitted gang affiliation and risk to public safety." Lawyers for Mr. Ramirez have already filed a lawsuit saying that ICE has detained him unlawfully.

We, along with other local immigrant advocacy groups, believe that the detention of Mr. Ramirez is an isolated incident, and does not mean that ICE is going after everyone with DACA status. We hope that ICE will soon address their reason for detaining Mr. Ramirez, in order to give everyone more clarity. In the meantime, US Citizenship and Immigration Services (USCIS) continue to accept and approve applications for the DACA program.

[02/14/17]   Q: I’ve heard a lot of news about President Trump’s travel ban. Will that affect me?

A: On January 27, 2017 Trump signed an executive order suspending visas and restricting entry to the U.S. for nationals of 7 countries: Iraq, Syria, Iran, Libya, Somalia, Sudan and Yemen. The government also suspended action on all pending immigration applications for individuals from those seven for 90 days. However, a federal judge in Seattle temporarily blocked the order as unconstitutional, and the 9th Circuit Court of Appeals decided not to restore Trump’s travel ban. Trump plans to appeal the Court’s decision, but for now the ban remains blocked.

If you are from Iraq, Syria, Iran, Libya, Somalia, Sudan and Yemen, please consult with an immigration attorney before making decisions to leave or return to the US. US Citizenship and Immigration Services (USCIS) has affirmed that applications for immigrant status or citizenship are not affected by the executive orders issued by President Trump in January 2017.

If you are not from one of the seven countries listed in the executive order and you are a U.S. citizen or lawful permanent resident, or if you have advance parole or a visa, you are you will not be barred from re-entering the U.S. If you have a criminal history, or if you seek to travel with advance parole under Deferred Action for Childhood Arrivals, contact an immigration attorney for advice before you make travel plans.

As always, if you are undocumented, travel by airplane, even within the U.S., is not recommended.
